By using the facilities at The Retreat Guesthouse, you acknowledge and agree to the following terms and conditions. Your use of our facilities is entirely at your own risk. The Retreat Guesthouse, including its directors, employees, agents, and representatives (collectively referred to as “The Retreat”), shall not be liable for any injury, loss, damage, or claim of any nature arising out of or in connection with your use of the facilities.
2. Health and Safety
You are responsible for ensuring that you are in good health and physically capable of using the facilities. It is recommended that you consult with a medical professional prior to engaging in any physical activity. By using our facilities, you confirm that you do not suffer from any medical condition that would impair your ability to use the facilities safely.
3. Equipment Use
All equipment and facilities must be used in accordance with the posted instructions and guidelines. You are solely responsible for your use of the equipment. The Retreat is not liable for any injuries or damages resulting from improper use or failure to follow instructions.
4. Supervision of Minors
If you are bringing children or minors onto the premises, you are responsible for their supervision and safety at all times. The Retreat is not liable for any injuries, accidents, or damages involving minors.
5. Personal Property
The Retreat is not responsible for any loss, theft, or damage to personal property brought onto the premises. We recommend that you do not leave valuables unattended in the facilities.
6. Indemnification
You agree to indemnify and hold harmless The Retreat from any and all claims, liabilities, damages, costs, and expenses (including legal fees) arising from your use of the facilities or any breach of these terms and conditions.
7. Compliance with Rules and Regulations
You agree to abide by all rules, regulations, and policies established by The Retreat regarding the use of the facilities. The Retreat reserves the right to revoke access to the facilities for any violation of these rules or for any conduct deemed inappropriate or disruptive.
8. Assumption of Risk
You acknowledge that participation in activities at The Retreat involves inherent risks, including but not limited to physical injury, property damage, or even death. You accept these risks voluntarily and waive any claims against The Retreat for any injuries or damages incurred while using the facilities.
9. Photography and Video Recording
By using the facilities, you consent to photographs or video recordings that may be taken by The Retreat for promotional or marketing purposes. If you do not wish to be photographed or recorded, please inform The Retreat staff in advance.
10. Governing Law
This disclaimer shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from the use of the facilities shall be subject to the exclusive jurisdiction of the South African courts.
11. Modification of Terms
The Retreat reserves the right to modify this disclaimer at any time without prior notice. It is your responsibility to review the disclaimer regularly for any changes. Your continued use of the facilities constitutes acceptance of any modified terms.
